Agency Relationships

When real estate professionals work with sellers and buyers of property, the laws of Arizona recognize the establishment of ŇagencyÓ relationships.

In general, there are three categories of agency relationships, depending on the role of the parties in the transaction:


*SellerŐs Agent:
An Agent under a listing agreement with the Seller or as a subagent of the Seller acts as the Agent for the Seller only.

*BuyerŐs Agent:
An Agent other than the SellerŐs Agent can agree with the Buyer to act as the Agent for the Buyer only. In these situations, the BuyerŐs Agent is not representing the Seller even if the BuyerŐs Agent is receiving compensation for services rendered, either in full or in part, from the Seller or through the SellerŐs Agent.

*Disclosed Dual Agent:
The Agent in this transaction, together with the AgentŐs licensees collectively referred to as ŇAgent,Ó is authorized to represent both Seller and Buyer in this transaction. Seller and Buyer understand that the Agent cannot represent the interests of one party to the exclusion or detriment of the other party.


When you select Pam Fain to market your property, she becomes your "Seller's Agent" under an Exclusive Right to Sell listing agreement. As such, she will work for your best interests throughout the entire process. This includes marketing the property, negotiating with buyers on your behalf, and seeing that details of the transaction are carried out as you have agreed.

When an offer is presented, the buyers will have a separate agency relationship with their broker. This is known as the "Buyer's Agent."
